Terms of sale & delivery

PREAMBLE

The customer acknowledges that he/she has read all of these general terms and conditions of sale prior to placing the order. The customer also acknowledges that he/she has the capacity to enter into the present contract.

SCOPE OF APPLICATION OF THE GENERAL CONDITIONS OF SALE

Our sales are subject to the present general conditions of sale. The fact that a user fills in the order form on the site and confirms the order by clicking on the "Order" button, implies full acceptance of these general terms and conditions of sale, which alone are applicable to the contract thus concluded.

OBJECT

The purpose of this contract is to define the rights and obligations of the parties in the context of the sale of the material offered on the bedshop.ch website. This contract concerns the acquisition of goods, and is concluded between SwissBeds.ch, and the customer.

MATERIAL AVAILABILITY

For items in stock, the customer can pick them up immediately at our warehouse in Morges, after confirmation from the shop. For shipments, it takes about 2 to 5 days, or as soon as possible after payment is received. For items that are not in stock, the customer will be informed of the delay.

ILLUSTRATIONS

The photographs illustrating the products offered to customers may vary in colour or texture, and SwissBeds.ch cannot be held responsible in any way.

ORDER CONFIRMATION

Confirmation, or where applicable refusal to accept an order, will be the subject of an e-mail at the time of validation of the order, and at the latest 72 hours after receipt of an order.

PRICES

The prices invoiced are those in force at the time of the order, the applicable VAT is that of the day of delivery. In the event of delivery outside Switzerland, customs taxes, transport costs and formalities are the exclusive responsibility of the customer. The customer undertakes to check the possibilities of importing the items ordered with regard to the territory of the country of delivery.

PAYMENTS

The payment is made through the secure site of DATATRANS with different credit cards, or by making the payment directly to our bank, indicated during the payment.

TERMS OF DELIVERY

Delivery is made to the address indicated by the customer at the time of ordering, either by our own services or by a carrier. Transport costs are not included in the sales prices and are specified for each order. In all cases, a final confirmation of the actual transport costs will be agreed with the customer in order for the order to be accepted.

TRANSPORT

Includes liability up to a goods value of CHF 1,000 per package. A graduated supplementary insurance up to max. CHF 5'000.00 is possible against payment of a premium. To be agreed with the shop before the goods are dispatched. It is the customer's responsibility to check the contents of the parcel upon delivery and, if necessary, to make any reservations to the carrier immediately on site.

DELIVERY

In the case of delivery or delivery-assembly, an approximate date and time of delivery will be agreed with the customer, either by e-mail or by telephone.

DELAYS

Under no circumstances can SwissBeds.ch be held responsible for delays in delivery caused by a manufacturer, a delivery person, a carrier or a forwarder.

RIGHT OF WITHDRAWAL

The customer has a right of withdrawal of 7 working days from the date of receipt of the material. The material must be returned in perfect condition and in its original packaging, complete and sealed. If these conditions are not met, a corresponding deduction will be made. The customer is responsible for the costs of returning the goods, as well as the risks associated with transport. Hygiene items such as mattresses, cushions, duvets, etc., will not be returned or exchanged.

GUARANTEE

Products are guaranteed against manufacturing defects for a period determined by the manufacturer, but for a minimum of one year. The mattresses are guaranteed for 5 years against all manufacturing defects, 100% for the first year, then decreasing by 10% per year. In case of a warranty claim, the shipping costs will be charged to the customer.

The warranty does not cover: failures due to improper use, failure to follow the instructions for use, or abnormal use of the product due to negligence or fault on the part of the customer. Replacement of parts that are subject to normal wear and tear or due to abnormal use of the product. Damage resulting from a natural phenomenon or an accident (water damage, fire, etc.).

RESERVATION OF OWNERSHIP

SwissBeds.ch retains ownership of the goods sold until full payment of the price. This rule does not prevent the transfer of risks to the customer upon conclusion of the sale. This includes, for example, the risks of loss and deterioration.

SETTLEMENT OF DISPUTES

The parties expressly agree that this agreement is subject to Swiss law. In the event of a dispute concerning the sale of products and the execution and interpretation of the present agreement, only the courts of Morges shall have jurisdiction.
